Deportation, Exclusion and Removal

Englewood, New Jersey, Deportation Defense Attorneys

The possibility of being removed from the United States can be frightening for anybody, especially when their families are established in this country and when they have spent a great deal of time away from their home country. Deportation can mean being divided from U.S. citizen spouses and children, and it can mean losing a life that you have fought hard to establish here.

At The Law Offices of Marilyn Labrada Dume, in Englewood, New Jersey, we understand. Our attorneys defend people in proceedings for deportation, exclusion and removal. We work hard to allow people to lawfully stay in the United States.

With in-depth knowledge of the legal system, we represent clients in removal proceedings in Immigration Court or before the Board of Immigration Appeals (BIA). Immigration courts and the BIA are part of the Executive Office for Immigration Review (EOIR) within the Department of Justice (DOJ).

Relief From Removal

Removal from the United States can happen whenever someone is found to be deportable or inadmissible. Many criminal offenses are deportable. People can be caught being out of status, often when they are stopped for something as simple as a traffic ticket. Other times, they missed a hearing and may not have even known about it. People illegally in the United States also become victims of raids and snitches—people who turn them in to the United States government.

If you face deportation, you do have options. If eligible, individuals in removal proceedings can apply for various immigration benefits—which if granted—provide relief from removal, such as adjustment to permanent resident status, cancellation of removal and certain waivers of inadmissibility. Eligible individuals may also seek asylum or withholding of removal, among other forms of protective relief. Working with a skilled attorney can help you explore all your options.

Asylum and Withholding of Removal

We also handle asylum and withholding of removal cases (formerly called “withholding of deportation”). In order to qualify for asylum, you and your lawyer must establish that you are a refugee who is unable or unwilling to return to your home country because of persecution. This persecution must be based on race, religion, nationality or membership in a particular social or political group. You may still be eligible for withholding of removal if asylum is not granted. If you feel that you may qualify for asylum—or withholding of removal—in the United States, it is best to contact an attorney as soon as possible.
